SMS via PC Terms & Conditions
By using SMS via PC (“the Service”) I agree that I have read, and agree to comply with, the following terms and conditions governing the use of the Service.

  1. This is an agreement between me and Cable & Wireless (Barbados) Limited (“Cable & Wireless”) related to my use of the Service. The agreement consists of these terms and conditions, Cable & Wireless Terms & Conditions for Mobile Telephone Service, Cable & Wireless’ Terms and Conditions for Internet Service and Cable & Wireless’ Acceptable Use Policy. Cable & Wireless may revise these terms and conditions at any time by posting amended terms and conditions on this website and I agree to visit this page periodically to review any amendments to the terms and conditions, because I agree that they are binding on me. I am deemed to have consented to these terms and conditions and to the Acceptable Use Policy by my use of the Service.
  2. The Service is offered subject to the availability of the necessary facilities. I agree to use the Service for personal and non-commercial purposes only. I agree not to use the Service for any unlawful or abusive purpose, including but not limited to any use which disrupts Cable & Wireless' system or other customers, damages Cable & Wireless' property, or interferes with Cable & Wireless' ability to provide service to customers. I agree to comply with all laws while using the Service and not to transmit any communication that would violate any laws, court order or regulation or would likely be offensive, defamatory, libelous, slanderous, obscene, abusive, menacing, threatening and/or immoral to the recipient. I am responsible for all content I transmit through the Service. I agree that Cable & Wireless may limit, suspend or terminate my use of the Service, if it deems, in its sole discretion that I have not complied with these terms and conditions. Cable & Wireless is not responsible for any mobile mail messages which may be lost or Cable & Wireless is not responsible for messages that are lost or significantly delayed due to transmission via the Internet. Cable & Wireless is not responsible for the content contained in messages sent to users of the Service.

  3. Cable & Wireless accepts liability for its failure to perform its obligations under these terms and conditions. However, Cable & Wireless' liability is limited as set out below.

  4. Cable & Wireless does not exclude or restrict its liability for death or personal injury caused by its negligence, or for any liabilities which cannot by law be excluded.

  5. Cable & Wireless will not be liable for any lack of privacy I may experience while using the Service. I agree that Cable & Wireless has the right to intercept, disclose, or delete any messages that I send through the Service in order to protect its rights, and I consent to any interception, alteration, replication, monitoring or interruption that may occur to any messages that I send through the Service.

  6. Cable & Wireless' liability under these terms and conditions is limited to Bds $ 100.

  7. UNDER NO CIRCUMSTANCES WILL CABLE & WIRELESS BE LIABLE TO ME OR ANY OTHER PERSON FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER THAT ARISE FROM MY OR ANY OTHER PERSON'S USE OF THE SERVICE. CABLE & WIRELESS IS NOT LIABLE FOR ANY ACT ASSOCIATED WITH THE PROPER EXERCISE OF ITS RIGHTS UNDER THESE TERMS AND CONDITIONS.

  8. Cable & Wireless will use all reasonable endeavors to provide the Service in accordance with best practice and with that degree of skill, care and diligence exercised by skilled and experienced companies in the telecommunications industry. CABLE & WIRELESS DOES NOT WARRANT THAT THE SERVICE, WILL BE UNINTERRUPTED OR ERROR FREE. OTHER THAN ANY EXPRESS WARRANTIES CONTAINED IN THESE TERM AND CONDITIONS CABLE & WIRELESS DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

  9. I agree that my consent to these terms and conditions is a material part of Cable & Wireless’ decision to provide the Service to me.
